3. Disclaimer of Sparky's Liability

 

Sparky's makes no representation or guarantee that any product sold is compliant with the laws in the Buyer's local jurisdiction.

The Buyer agrees to indemnify, defend, and hold harmless Sparky's from and against any and all claims, actions, costs, liabilities, losses, damages, and expenses (including attorney's fees) arising out of or related to:

  • Any violation of any local, State, or Federal law or regulation by the Buyer.

  • The purchase, resale, possession, or distribution of products sold by Sparky's that are found to be non-compliant or illegal in the Buyer's jurisdiction, specifically including those related to flavor laws.

The Buyer’s purchase constitutes an affirmation that they have conducted all necessary due diligence and are legally permitted to purchase and resell the ordered products in their designated market.
